Welcome to Dracos.

These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the Dracos website, marketplace, digital products, seller services, payment services, customer accounts, seller accounts, downloads, and other services provided through the platform.

Dracos is a digital marketplace where independent creators, businesses, educators, developers, professionals, and other sellers may offer digital products and resources to buyers.

By creating an account, purchasing a product, downloading a product, listing a product, becoming a seller, or otherwise using Dracos, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you must not use Dracos.


1. About Dracos

Dracos is a digital marketplace that enables users to:

  • Discover digital products and resources;
  • Purchase digital products;
  • Access purchased products through their digital library;
  • Download eligible digital products;
  • Create and manage seller accounts;
  • Upload and sell eligible digital products;
  • Receive payments from qualifying sales;
  • Communicate with other users where such features are provided;
  • Leave reviews and ratings;
  • Access other marketplace features introduced from time to time.

Dracos may offer products directly and may also host products offered by independent third-party sellers.

Unless expressly stated otherwise, Dracos is a marketplace operator and is not the creator, author, publisher, developer, instructor, or owner of third-party products.


2. Definitions

For purposes of these Terms:

"Dracos", "we", "us", or "our" means the operator of the Dracos platform.

"User", "you", or "your" means any person accessing or using Dracos.

"Buyer" means a user who purchases or obtains access to a digital product through Dracos.

"Seller" means a user authorized to list and sell digital products through Dracos.

"Product" means any digital resource, file, content, software, course, ebook, template, document, media, or other digital item offered through the marketplace.

"Digital Product" means a product delivered electronically rather than physically.

"Order" means a confirmed request by a buyer to purchase one or more products.

"Purchase Price" means the amount displayed and payable for a product at checkout, excluding any separately disclosed fees or applicable taxes.

"Marketplace" means the Dracos website and associated services through which products are listed, purchased, delivered, and managed.

"Seller Content" means product files, descriptions, images, previews, videos, metadata, trademarks, logos, and other content submitted by a seller.

"Account" means a registered Dracos user account.


3. Eligibility

You must provide accurate information when creating an account.

You must be legally capable of entering into a binding agreement under the laws applicable to you.

If you are under the applicable legal age to independently enter into contracts, you may use Dracos only with the involvement and permission of a parent or legal guardian where required by applicable law.

You may not create an account on behalf of another person without authorization.

You may not maintain multiple accounts for the purpose of circumventing restrictions, suspensions, purchase limits, seller requirements, or other platform controls.


4. Your Dracos Account

You are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for all activity occurring through your account unless you can demonstrate that the activity resulted from circumstances for which you were not responsible.

You agree to:

  • Provide accurate and current information;
  • Keep your password and authentication credentials secure;
  • Notify us promptly if you believe your account has been compromised;
  • Not share your account with another person;
  • Not impersonate another person or organization;
  • Not use another person's account without authorization.

Dracos may require additional verification for certain activities, including seller onboarding, withdrawals, fraud prevention, or compliance purposes.


5. Marketplace Role

Dracos provides the technology and marketplace infrastructure through which buyers and sellers can interact.

For third-party products, the seller is generally responsible for:

  • The legality of the product;
  • Ownership or licensing rights;
  • Product accuracy;
  • Product quality;
  • Product description;
  • Product availability;
  • Product support where applicable;
  • Compliance with applicable laws;
  • Any promises or representations made about the product.

Dracos does not automatically guarantee that every third-party product is accurate, complete, original, suitable for a particular purpose, or free from infringement.

We may review, moderate, approve, reject, restrict, remove, or suspend products and sellers where appropriate.


6. Product Listings

Sellers must provide accurate and complete information about every product.

A product listing should clearly identify, where applicable:

  • Product title;
  • Product type;
  • Description;
  • Contents;
  • File format;
  • Number of files or resources included;
  • Requirements for use;
  • Price;
  • License or usage restrictions;
  • Whether updates are included;
  • Whether customer support is provided;
  • Any material limitations;
  • Any applicable refund conditions.

Sellers must not intentionally misrepresent the nature, quality, origin, functionality, ownership, or value of a product.

Product previews must accurately represent the product being sold.

Dracos may require changes to a listing before approving it.


7. Prohibited Products

Dracos may prohibit products that violate applicable laws, third-party rights, platform policies, or reasonable marketplace standards.

Unless expressly authorized by Dracos, sellers must not offer:

  • Stolen or illegally obtained digital content;
  • Pirated books, courses, software, videos, exams, or other copyrighted material;
  • Unauthorized copies of paid educational resources;
  • Counterfeit products;
  • Malware, ransomware, spyware, credential stealers, or other malicious software;
  • Products designed primarily to facilitate fraud, identity theft, or unauthorized access;
  • Stolen credentials, databases, personal information, or confidential information;
  • Products containing unlawfully obtained personal data;
  • Content that infringes copyright, trademark, patent, trade secret, or other intellectual property rights;
  • Products that violate applicable laws or regulations;
  • Products designed to facilitate illegal activity;
  • Misleading or fraudulent products;
  • Products that Dracos reasonably determines create significant legal, security, financial, or reputational risk.

Dracos may maintain additional prohibited-product rules and update them when necessary.


8. Educational and Copyrighted Materials

Dracos may host educational resources such as past questions, study guides, solutions, notes, mock examinations, tutorials, and related materials.

Sellers must have the necessary rights, permissions, licenses, or lawful basis to distribute any material they upload.

The fact that material is publicly available online does not automatically mean that it may be copied, republished, sold, or redistributed.

Sellers must not upload copyrighted materials belonging to schools, examination bodies, publishers, authors, organizations, or other rights holders unless they have the necessary authorization or the use is otherwise lawful.

Where appropriate, sellers may be required to confirm that they have the necessary rights before a product is approved.


9. Intellectual Property

Dracos respects intellectual property rights.

Unless otherwise stated, Dracos owns or has appropriate rights to its:

  • Website;
  • Platform software;
  • Branding;
  • Logo;
  • User interface;
  • Design elements;
  • Original platform content;
  • Documentation;
  • Text and graphics;
  • Technology and functionality.

You may not copy, reproduce, modify, distribute, reverse engineer, sell, or commercially exploit Dracos's proprietary materials without appropriate authorization.

A purchase of a digital product does not transfer ownership of the underlying intellectual property to the buyer unless the applicable product license expressly states otherwise.


10. Seller Ownership and License

Sellers retain ownership of their original intellectual property, subject to the rights granted under these Terms.

By submitting Seller Content to Dracos, the seller grants Dracos a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, advertise, distribute, and technically modify that content as reasonably necessary to:

  • Operate the marketplace;
  • Display product listings;
  • Process purchases;
  • Deliver products;
  • Provide downloads;
  • Generate previews and thumbnails;
  • Promote products on Dracos;
  • Maintain backups;
  • Prevent fraud and abuse;
  • Provide customer support;
  • Improve the platform.

This license continues for as long as reasonably necessary to operate the services and to satisfy legal, security, accounting, dispute-resolution, and backup requirements.

Dracos does not acquire ownership of Seller Content merely because it is uploaded to the platform.


11. Buyer Product License

Unless a product listing expressly provides different licensing terms, purchasing a digital product grants the buyer a limited, non-exclusive, non-transferable license to use the product for personal or internal business purposes as permitted by the product description.

Unless expressly permitted by the applicable license, buyers may not:

  • Resell the product;
  • Redistribute the product;
  • Upload it to another marketplace;
  • Share paid download links;
  • Give unauthorized copies to other people;
  • Publish the product publicly;
  • Remove copyright notices;
  • Claim authorship of another person's work;
  • Use the product in a manner that infringes the seller's rights.

Different products may have different licenses. Buyers are responsible for reviewing the license associated with each product before using it.


12. Purchases and Orders

Before completing a purchase, buyers should review:

  • Product description;
  • Price;
  • Product format;
  • Included materials;
  • License terms;
  • Seller information;
  • Refund conditions;
  • Any applicable restrictions.

An order is considered confirmed after successful payment verification by Dracos or its authorized payment provider.

A payment attempt that appears successful in a buyer's browser does not by itself guarantee that the transaction has been completed.

Dracos may cancel or place an order on hold where there is suspected fraud, payment failure, technical error, duplicate transaction, regulatory concern, or other legitimate reason.


13. Pricing

Prices are displayed in the currency supported by the applicable marketplace transaction.

Sellers are responsible for setting accurate product prices.

Dracos may charge marketplace commissions, transaction fees, payment processing fees, promotional fees, or other disclosed charges.

Any applicable fees should be displayed to the relevant party before the transaction is completed.

Dracos may correct obvious pricing or listing errors.

Where a pricing error materially affects an order, Dracos may cancel the affected order and issue an appropriate refund.


14. Payments

Dracos may use third-party payment providers to process transactions.

Payment methods may include mobile money, bank-supported payment methods, cards, or other payment services supported by Dracos.

Dracos does not intentionally store sensitive payment credentials such as mobile money PINs or card security credentials.

Payment processing may be subject to the terms and privacy policies of the applicable payment provider.

Dracos may delay fulfillment or seller payouts until payment has been verified.


15. Digital Delivery

Following successful payment verification, eligible products may become available through the buyer's Dracos account or another delivery method specified at checkout.

Digital products may be:

  • Downloadable;
  • Accessible through a customer library;
  • Delivered through an account-based access system;
  • Provided through a time-limited or subscription-based entitlement where applicable.

Dracos may apply reasonable download limits, access controls, expiration dates, or security measures to protect sellers and prevent unauthorized distribution.

Buyers must not attempt to bypass technical controls designed to protect digital products.


16. Customer Library and Entitlements

A buyer's purchased products may appear in their Dracos library.

Access to a product may be affected by:

  • Refunds;
  • Chargebacks;
  • Fraud investigations;
  • Seller rights issues;
  • Copyright claims;
  • Product removal;
  • Account termination;
  • Expiration of a license;
  • Violation of product license terms.

Where legally and technically possible, Dracos will seek to preserve legitimate buyer access where a product is removed for reasons unrelated to the buyer's conduct.


17. Refunds and Cancellations

Because Dracos primarily provides digital products, refunds may differ from those applicable to physical products.

A refund may be considered where:

  • The purchased product is materially different from its listing;
  • The product is corrupted or unusable;
  • The buyer receives the wrong product;
  • The seller materially misrepresented the product;
  • The same purchase was charged more than once;
  • The transaction was unauthorized or fraudulent;
  • The product is removed because it violates intellectual property rights;
  • A technical failure prevents legitimate access to a purchased product;
  • A refund is otherwise required by applicable law.

Where a buyer has already downloaded or accessed a digital product, eligibility for a refund may depend on the nature of the issue, the product license, applicable law, and whether the product has been substantially consumed.

Refunds are not automatically guaranteed simply because a buyer changes their mind after receiving or accessing a digital product.

Dracos may request reasonable information to investigate a refund request.

Where a refund is approved, the refund method may depend on the original payment method and the capabilities of the applicable payment provider.

Nothing in this section limits any mandatory consumer rights that cannot lawfully be excluded.


18. Chargebacks and Payment Disputes

Buyers agree to contact Dracos first where they believe there is a legitimate problem with a purchase.

Fraudulent or abusive chargebacks may result in:

  • Account restrictions;
  • Suspension of downloads;
  • Cancellation of pending orders;
  • Recovery of amounts owed;
  • Seller account action;
  • Further investigation.

Nothing in this section prevents a buyer from exercising rights available under applicable law.


19. Seller Eligibility

To become a seller, a user may be required to complete an onboarding process.

Dracos may request information necessary to verify:

  • Identity;
  • Contact information;
  • Business information where applicable;
  • Payment information;
  • Ownership or authorization relating to products;
  • Compliance information.

Approval as a seller is not guaranteed.

Dracos may suspend or revoke seller privileges where a seller violates these Terms or presents a material risk to buyers or the marketplace.


20. Seller Responsibilities

Sellers are responsible for:

  1. Owning or having appropriate rights to everything they sell;
  2. Providing accurate product information;
  3. Delivering the product described;
  4. Maintaining product quality;
  5. Responding to reasonable buyer questions;
  6. Respecting applicable laws;
  7. Respecting intellectual property rights;
  8. Maintaining accurate payout information;
  9. Not manipulating ratings or reviews;
  10. Not engaging in fraudulent transactions;
  11. Not using Dracos to distribute prohibited content;
  12. Cooperating with legitimate investigations and disputes.

A seller may not use Dracos to sell products that they are legally prohibited from distributing.


21. Seller Fees and Commission

Dracos may retain a marketplace commission from qualifying sales.

The applicable commission rate will be displayed in the seller's dashboard, seller agreement, or applicable commercial terms.

For example, if Dracos applies a 15% marketplace commission, the seller receives the applicable net amount after the commission and any other disclosed deductions.

Dracos may change commission rates for future transactions by providing appropriate notice.

Changes will not retroactively alter commissions already finalized unless required to correct an error, fraud, refund, chargeback, or similar transaction issue.


22. Seller Wallet and Earnings

Eligible seller earnings may be recorded in a seller wallet or ledger.

Wallet balances may include:

  • Completed sales;
  • Marketplace commissions;
  • Refund adjustments;
  • Chargebacks;
  • Promotional deductions;
  • Administrative adjustments;
  • Withdrawal transactions.

A displayed balance does not necessarily mean that funds are immediately withdrawable.

Dracos may place funds on a temporary hold to account for:

  • Payment verification;
  • Refund periods;
  • Chargebacks;
  • Fraud investigations;
  • Copyright disputes;
  • Account verification;
  • Compliance requirements.

23. Seller Withdrawals

Sellers may request withdrawals when they meet applicable eligibility requirements.

Withdrawal requirements may include:

  • Minimum withdrawal amount;
  • Verified seller account;
  • Valid payout information;
  • Available balance;
  • No unresolved disputes;
  • No active fraud or compliance investigation.

Withdrawal processing times may vary depending on the payment provider and transaction conditions.

Dracos is not responsible for delays caused by third-party financial institutions or payment providers beyond Dracos's reasonable control.


24. Refunds, Chargebacks and Seller Balances

When a transaction is refunded or reversed, the corresponding seller earnings may be deducted from the seller's available or future balance.

If the seller's wallet does not contain sufficient funds to cover a valid reversal, Dracos may:

  • Deduct the amount from future earnings;
  • Place a hold on future payouts;
  • Request repayment;
  • Take other lawful recovery measures.

25. Product Updates

Where a seller states that updates are included, the seller should make reasonable efforts to provide those updates through Dracos.

Dracos is not responsible for promises made by sellers unless expressly adopted by Dracos.

If a product is permanently discontinued, Dracos may remove it from sale.


26. Reviews and Ratings

Buyers may be permitted to review products they have purchased.

Reviews must be honest and based on genuine experience.

Users must not:

  • Post fake reviews;
  • Pay for positive reviews;
  • Threaten sellers for favorable reviews;
  • Post reviews on behalf of another person;
  • Manipulate ratings;
  • Use reviews to promote unrelated products;
  • Include private or sensitive information;
  • Use abusive, discriminatory, or unlawful content.

Dracos may remove reviews that violate these Terms or applicable review policies.


27. Prohibited User Conduct

You may not use Dracos to:

  • Commit fraud;
  • Launder money;
  • Facilitate illegal transactions;
  • Obtain unauthorized access to accounts or systems;
  • Distribute malware;
  • Upload malicious files;
  • Steal or distribute personal information;
  • Circumvent payment systems;
  • Abuse refund systems;
  • Manipulate marketplace rankings;
  • Manipulate reviews;
  • Create fraudulent accounts;
  • Circumvent seller restrictions;
  • Scrape or harvest platform data without authorization;
  • Attack, disrupt, or overload the platform;
  • Attempt to bypass download protection;
  • Reverse engineer protected platform components except where expressly permitted by applicable law;
  • Upload unlawful or infringing content;
  • Impersonate Dracos, a seller, buyer, or another person;
  • Use the platform for activities prohibited by applicable law.

28. Account Suspension and Termination

Dracos may suspend, restrict, or terminate an account where we reasonably believe that:

  • These Terms have been violated;
  • Fraud has occurred;
  • Payment abuse has occurred;
  • Intellectual property rights have been infringed;
  • Prohibited products have been uploaded;
  • The account presents a security risk;
  • The account is being used for illegal activity;
  • False information has been provided;
  • Seller obligations have been materially breached.

Where appropriate, Dracos may provide notice and an opportunity to resolve the issue.

However, immediate action may be taken where necessary to protect users, the platform, payment systems, or third parties.


29. Effect of Account Termination

Termination of an account may result in loss of access to platform features.

Where legally required or reasonably possible, Dracos may preserve access to legitimately purchased products that are not subject to a legal, copyright, fraud, security, or licensing restriction.

Outstanding seller balances may be withheld temporarily where necessary to investigate refunds, chargebacks, fraud, disputes, or legal obligations.

Termination does not eliminate obligations that by their nature should continue after termination.


30. Copyright and Intellectual Property Complaints

If you believe that a product available on Dracos infringes your copyright or other intellectual property rights, you may report it to Dracos.

A report should provide sufficient information to allow us to identify:

  • The intellectual property being claimed;
  • The allegedly infringing product;
  • The relevant seller;
  • The basis for the complaint;
  • Your contact information;
  • Evidence supporting your claim where reasonably available.

Dracos may remove, restrict, or disable access to disputed content while investigating.

We may request additional information from the complainant or seller.

Repeated infringement may result in seller suspension or termination.


31. Seller Representations

By uploading a product, the seller represents that:

  1. They have the right to sell or distribute the product;
  2. The product does not knowingly infringe third-party rights;
  3. The product does not contain unlawfully obtained confidential information;
  4. The product does not contain malicious code;
  5. The product description is materially accurate;
  6. The product complies with applicable laws;
  7. Any required licenses or permissions have been obtained;
  8. The seller is authorized to grant Dracos the rights described in these Terms.

The seller remains responsible for breaches of these representations.


32. Data and Privacy

Dracos collects and processes personal information necessary to operate the marketplace, including account creation, authentication, purchases, payments, customer support, fraud prevention, seller onboarding, and platform security.

Our collection and use of personal information is governed by the Dracos Privacy Policy, which forms part of these Terms by reference.

Users should review the Privacy Policy before using the platform.


33. Security

Dracos takes reasonable technical and organizational measures to protect the platform and user information.

However, no internet service can guarantee absolute security.

Users must not attempt to compromise the security of Dracos or its users.

You must promptly report suspected vulnerabilities, unauthorized access, compromised accounts, malicious files, or security incidents through the appropriate Dracos support channel.


34. Third-Party Services

Dracos may rely on third-party providers for services including:

  • Payment processing;
  • Email delivery;
  • Authentication;
  • Hosting;
  • File storage;
  • Analytics;
  • Fraud prevention;
  • Notifications.

Third-party services may have their own terms and privacy policies.

Dracos is not responsible for independent failures of third-party services outside our reasonable control.


35. Platform Availability

We aim to keep Dracos available and reliable, but we do not guarantee uninterrupted access.

The platform may occasionally be unavailable because of:

  • Maintenance;
  • Security updates;
  • Infrastructure failures;
  • Software errors;
  • Payment-provider outages;
  • Internet or telecommunications failures;
  • Events outside our reasonable control.

We may temporarily restrict access where necessary to protect the platform or users.


36. Digital Product Availability

Dracos does not guarantee that every product will remain available permanently.

A product may become unavailable because of:

  • Seller withdrawal;
  • Copyright claims;
  • Legal requirements;
  • Platform policy violations;
  • Seller account termination;
  • Security concerns;
  • Technical issues.

Where appropriate, Dracos may notify affected buyers or provide an appropriate remedy.


37. No Professional Advice

Products available through Dracos may contain educational, technical, business, career, financial, cybersecurity, or other informational material.

Unless explicitly stated otherwise, such materials are provided for informational purposes only.

Purchasing or accessing a product does not create a professional-client relationship between the buyer and the seller.

Users should obtain qualified professional advice where appropriate.


38. Disclaimer

To the maximum extent permitted by applicable law, Dracos provides the marketplace and platform services on an "as available" basis.

We do not guarantee that:

  • Every product will meet your expectations;
  • Third-party product information will always be error-free;
  • Every seller is qualified for the purpose you intend;
  • Every product will remain available indefinitely;
  • The platform will always operate without interruption;
  • Third-party services will always be available.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.


39. Limitation of Liability

To the maximum extent permitted by applicable law, Dracos will not be liable for indirect, incidental, special, consequential, or punitive losses arising from:

  • Use or inability to use the platform;
  • Third-party products;
  • Seller conduct;
  • Buyer conduct;
  • Unauthorized redistribution of purchased products;
  • Third-party payment-provider failures;
  • Loss of business or anticipated profits;
  • Loss of data caused by circumstances outside Dracos's reasonable control.

Where liability cannot legally be excluded, it will be limited to the extent permitted by applicable law.

Nothing in these Terms excludes liability for matters that cannot lawfully be excluded or limited.


40. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold Dracos and its operators, employees, contractors, and service providers harmless from claims, losses, damages, liabilities, costs, and expenses arising from:

  • Your violation of these Terms;
  • Your unlawful conduct;
  • Your infringement of third-party rights;
  • Seller Content you upload;
  • Your misuse of the platform;
  • Fraudulent transactions conducted through your account.

41. Disputes Between Buyers and Sellers

Where a dispute arises between a buyer and seller, Dracos may provide a dispute-resolution process.

Dracos may review:

  • Order information;
  • Payment records;
  • Product listings;
  • Download records;
  • Communications;
  • Refund requests;
  • Evidence submitted by the parties.

Dracos may make a marketplace decision regarding refunds, access, product removal, or seller restrictions where appropriate.

Such decisions do not prevent a party from exercising rights available under applicable law.


42. Disputes With Dracos

If you have a complaint concerning Dracos, please contact our support team first so that we can attempt to resolve the issue informally.

We encourage users to provide:

  • Account email;
  • Order number where applicable;
  • Relevant product;
  • Description of the issue;
  • Supporting evidence.

We will make reasonable efforts to review legitimate complaints.


43. Taxes

Sellers are responsible for determining and complying with tax obligations applicable to their activities.

Where required by law, Dracos may collect, report, withhold, or provide information relating to transactions.

Users should obtain appropriate tax advice for their circumstances.


44. Changes to These Terms

Dracos may update these Terms from time to time.

When material changes are made, we may provide notice through the platform, email, or another reasonable method.

The updated Terms will become effective on the stated effective date.

Continued use of Dracos after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.


45. Electronic Communications

By using Dracos, you consent to receiving electronic communications relating to:

  • Account activity;
  • Purchases;
  • Payments;
  • Orders;
  • Downloads;
  • Seller activity;
  • Security;
  • Support;
  • Important service announcements;
  • Changes to applicable policies.

Transactional and legally important communications may continue even if you opt out of promotional communications.


46. Electronic Acceptance

You agree that clicking an acceptance button, checking an acceptance box, creating an account, completing a purchase, submitting a seller application, uploading a product, or otherwise taking an action that indicates acceptance may constitute electronic acceptance of these Terms to the extent permitted by applicable law.

You should retain a copy of these Terms for your records.


47. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent where such consent is required.

Dracos may transfer or assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or transfer of the platform, subject to applicable law.


48. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary, and the remaining provisions will continue to apply.


49. Entire Agreement

These Terms, together with the Dracos Privacy Policy, Refund Policy, Seller Policy, Copyright Policy, and other policies expressly incorporated into these Terms, constitute the agreement governing your use of Dracos.

Where a specific product has additional license terms or conditions, those terms may apply to that product.


50. Governing Law

These Terms shall be governed by the laws applicable to Dracos and its operations, including applicable laws of the Republic of Cameroon where applicable.

Nothing in these Terms is intended to deprive consumers of mandatory rights or protections provided by applicable law.

Any dispute that cannot be resolved amicably shall be submitted to the competent authorities or courts having jurisdiction under applicable law.
