1. Scope of This Policy

Sellers must not upload content that they know, or reasonably should know, infringes another person's intellectual property rights.

  • GCE or other examination materials;
  • Concours materials;
  • Paid study resources;
  • Software;
  • Source code;
  • Applications;

  • Images;
  • Templates;

  • Paid reports;
  • Training materials;
  • Subscription-only content;
  • Premium digital resources;
  • Other copyrighted or proprietary materials.

3. Educational and Examination Materials

Educational resources require particular care because many examination papers, textbooks, course materials, answer keys, and preparation resources may be protected by copyright or other intellectual property rights.

Dracos does not authorize sellers to upload or sell copyrighted educational materials merely because those materials are publicly accessible, commonly shared, or widely available online.

For example, a seller must not assume that they have the right to sell an examination paper simply because they found a copy online.

Sellers may offer educational resources where they have appropriate rights or where the material is lawfully created, licensed, permitted, or otherwise legally distributable.

Examples of generally safer products include:

  • Original study guides;
  • Original explanations and solutions;
  • Original mock examinations;
  • Original practice questions;
  • Original revision notes;
  • Original educational templates;
  • Public-domain materials where applicable;
  • Properly licensed educational resources.

Where ownership or authorization is unclear, Dracos may request evidence of the seller's rights before approving or continuing to list a product.


4. Copyright Infringement Reports

If you believe that a product or other content available on Dracos infringes your copyright, you may submit a copyright infringement report.

Reports should be submitted by the copyright owner or an authorized representative whenever possible.

To help us investigate the complaint efficiently, your report should contain sufficient information to identify the copyrighted work and the allegedly infringing material.


5. Information Required in a Copyright Complaint

A copyright complaint should generally include:

7. What Happens After a Complaint

  3. Temporarily restrict access to the disputed content where appropriate;
  4. Contact the relevant seller;
  5. Request evidence of ownership or authorization;
  6. Request clarification or additional documentation;
  7. Remove or disable access to the content where appropriate;
  8. Suspend or restrict the seller's account where warranted;
  9. Restore the content if the complaint is determined to be unsupported or otherwise resolved.

The existence of a complaint does not automatically establish that infringement has occurred.

Dracos may take temporary protective measures while an intellectual property dispute is being reviewed.


8. Seller Response

Where appropriate, Dracos may notify the seller that their product has been reported.

The seller may be asked to provide evidence demonstrating that they have the right to distribute or sell the disputed material.

Evidence may include:

  • Original work files;
  • Copyright ownership documentation;
  • License agreements;
  • Distribution agreements;
  • Written permission from the rights holder;
  • Publisher authorization;
  • Commercial licenses;
  • Other relevant documentation.

Dracos may evaluate the information provided by both parties before determining the appropriate action.


9. Counter-Notification

If a seller believes that content was removed or restricted incorrectly, the seller may contact Dracos and request a review.

A counter-notification should explain:

  • Why the seller believes the action was incorrect;
  • The seller's ownership or authorization;
  • Any supporting documentation;
  • Contact information;
  • Any additional information reasonably necessary to evaluate the dispute.

Dracos may forward relevant information to the complaining party where appropriate and permitted by law.

A counter-notification does not guarantee restoration of the content.


10. Repeat Infringers

Dracos may take stronger enforcement action against sellers or users who repeatedly upload or distribute infringing material.

Depending on the circumstances, enforcement may include:

  • Product removal;
  • Temporary product suspension;
  • Account restrictions;
  • Suspension of seller privileges;
  • Withholding or delaying certain funds where legally and contractually appropriate;
  • Permanent account termination;
  • Removal of associated listings;
  • Other appropriate measures.

Repeated infringement may result in permanent removal from the marketplace.


11. False or Abusive Copyright Complaints

Copyright reporting mechanisms must not be used to:

  • Harass sellers;
  • Remove legitimate competition;
  • Make knowingly false claims;
  • Disrupt legitimate business activity;
  • Abuse the marketplace moderation process;
  • Misrepresent ownership or authorization.

Submitting knowingly false or materially misleading information may result in appropriate action.

Dracos may reject complaints that are clearly incomplete, abusive, fraudulent, or unsupported.

Nothing in this section prevents a legitimate rights holder from submitting a good-faith complaint.


12. Other Intellectual Property Rights

This policy primarily addresses copyright, but Dracos also respects other intellectual property rights.

Reports involving:

  • Trade secrets;

13. Seller Representations

By uploading a product to Dracos, the seller represents that:

  • They have the necessary rights to upload the product;
  • They have the necessary rights to sell or license the product;

  • Any third-party material has been appropriately authorized where authorization is required;
  • They will cooperate with reasonable copyright investigations;
  • They will provide supporting documentation when reasonably requested.

14. Removal of Disputed Content

Dracos reserves the right to remove, restrict, suspend, or disable access to content where we reasonably believe that:

  • The content violates Dracos's Terms of Service or Seller Agreement;
  • Keeping the content available creates significant legal, security, or platform risk.

Where appropriate, Dracos may also suspend the associated seller account while an investigation is conducted.


15. Refunds Following Copyright Removal

If a purchased product is removed because of a verified copyright or intellectual property issue, Dracos may review affected purchases under its Refund Policy.

Depending on the circumstances, available remedies may include:

  • Replacement with an authorized product;
  • Restoration of access to a lawful replacement;
  • Full refund;
  • Partial refund;
  • Other appropriate resolution.

Refund eligibility may depend on the circumstances of the case and the applicable Refund Policy.


16. Seller Earnings Following Removal

When a product is removed because of an intellectual property complaint, Dracos may temporarily hold or adjust related seller earnings where reasonably necessary to address:

  • Refunds;
  • Chargebacks;
  • Customer claims;
  • Fraud;
  • Legal obligations;
  • Marketplace losses caused by the disputed product.

Any action affecting seller funds will be handled in accordance with the Dracos Terms of Service and Seller Agreement and applicable law.


17. Copyright Protection Does Not Guarantee Legal Determinations

Dracos is a marketplace platform and is not a court or intellectual property tribunal.

Reviewing, restricting, removing, or restoring content does not necessarily constitute a final legal determination regarding ownership or infringement.

Where a dispute cannot reasonably be resolved through the marketplace process, the parties may need to seek appropriate legal or judicial remedies.


18. Cooperation With Legal Authorities

Dracos may cooperate with courts, regulators, law-enforcement agencies, rights holders, and other legally authorized parties where required or permitted by applicable law.

We may preserve or disclose relevant information when legally required or reasonably necessary to:

  • Comply with legal obligations;
  • Respond to valid legal requests;
  • Protect users;
  • Investigate fraud or abuse;
  • Protect Dracos and its users;
  • Enforce our agreements;
  • Address intellectual property violations.

19. Copyright and Marketplace Safety

Dracos may use automated and manual moderation mechanisms to identify potentially problematic products.

  • Duplicate-content checks;
  • User reports;

  • Administrative review.

No automated system can identify every possible infringement. Users and rights holders are encouraged to report suspected violations.


20. Important Notice to Sellers

Before uploading a digital product, sellers should ask:

“Do I actually have the legal right to sell or distribute this?”

Finding content online does not automatically give you the right to sell it.

Owning a physical copy of a book, examination paper, course, software package, or other material does not necessarily give you the right to reproduce and commercially distribute digital copies.
